1. Acceptance of Terms

By accessing or using HEARD ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and HEARD.

2. Description of Service

HEARD is a web application that provides an AI-powered companion (Willow), journaling tools, calendar management, mood tracking, and related wellness features designed for mothers. The Service includes both free and paid subscription tiers.

3. Important Disclaimer — Not Medical Advice

Willow is an AI companion, NOT a licensed therapist, psychologist, psychiatrist, counselor, or medical professional.

  • Willow's responses are generated by artificial intelligence and are intended for emotional support and practical assistance only.
  • The Service is not a substitute for professional mental health treatment, medical advice, diagnosis, or treatment.
  • If you are experiencing a mental health crisis, suicidal thoughts, or a medical emergency, please contact 988 (Suicide & Crisis Lifeline), 911, or your local emergency services immediately.
  • HEARD is not liable for any decisions made based on Willow's responses.

4. User Accounts

  • You must sign in using a valid Google account to use the Service.
  • You are responsible for maintaining the security of your account.
  • You must be at least 18 years old to create an account.
  • You agree to provide accurate information and to update it as necessary.
  • One account per person. Account sharing is not permitted.

5. Subscription and Billing

Free Trial:

  • New users receive a 7-day free trial with full access to all premium features.
  • No credit card is required to start the free trial.
  • After the trial expires, your account will revert to the free tier unless you subscribe.

Premium Subscription:

  • Premium access is available for $4.99 per month.
  • Payment is processed securely through Stripe.
  • Each payment provides 30 days of premium access from the date of purchase.
  • Subscriptions do not auto-renew. You may repurchase at any time.

Free Tier:

  • Free tier users have access to 3 Willow messages per day, basic journaling, and calendar features.
  • AI-generated journaling prompts and detailed mood insights require a premium subscription.

6. Refund Policy

Due to the digital nature of the Service, all payments are generally non-refundable. However, if you experience technical issues that prevent you from accessing the Service, please contact us within 7 days of purchase and we will review your request on a case-by-case basis.

7. Referral Program

  • Users may share their unique referral link with others.
  • When a new user signs up through a referral link, both the referrer and the new user receive 30 days of premium access.
  • Referral rewards cannot be exchanged for cash or transferred.
  • We reserve the right to modify or discontinue the referral program at any time.
  • Abuse of the referral system (including creating fake accounts) will result in account termination.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Use the Service to harass, abuse, or harm others
  • Create multiple accounts to abuse free trials or referral rewards
  • Scrape, copy, or redistribute content from the Service
  • Use the Service to generate harmful, illegal, or misleading content

9. User Content

  • You retain ownership of all content you create (journal entries, calendar events, etc.).
  • By using the Service, you grant HEARD a limited license to store, process, and display your content solely for the purpose of providing the Service.
  • We will not sell, share, or publicly display your personal content.

10. Intellectual Property

The HEARD name, logo, Willow character, design, and all associated intellectual property are owned by HEARD. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, EMOTIONAL DISTRESS, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Termination

  • You may stop using the Service at any time.
  • We reserve the right to suspend or terminate your account for violation of these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • You may request deletion of your data by contacting us.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
